Zopa terms of use
1. Introduction
These terms apply to any person accessing the website www.zopa.com ("Website") and/or the Zopa app on iOS and Android ("App") (together "the Platforms"). They explain what you can expect from us and what we expect from you if you want to access the Platforms.
By using the Platforms, you agree to be bound by these terms. If you don't want to be bound by them you should not access the Platforms. If you download the App, separate app terms will also apply to you.
These terms are between you and Zopa Bank Limited ("we" and "us"). We own and operate the Platforms.
Depending on the products or services you use, you might have agreements with other companies in the Zopa Group. You will always see which company provides each service in the relevant terms. Zopa Bank Limited will take all your instructions on behalf of other Zopa companies.
Zopa's Privacy Notice and Cookie Policy also apply to you. The Privacy Notice gives details of how we collect, use, disclose, transfer and store your information, and your rights around this, and our Cookie Policy gives details of how we use cookies, and similar technologies in connection with the Platforms.
2. How is Zopa regulated?
Zopa Bank Limited is authorised by the Prudential Regulation Authority and regulated by the Financial Conduct Authority and the Prudential Regulation Authority and entered on the Financial Services Register (800542).
Zopa Bank Limited (10627575) is incorporated in England & Wales and has its registered office at: 1st Floor, Cottons Centre, 47-49 Tooley Street, London, SE1 2QG. Zopa is a member of Cifas -- the UK's leading anti-fraud association, and we are registered with the Office of the Information Commissioner (ZA275984).
3. Access to the Platforms
We do not guarantee that the Platforms, or any content on it, will always be available or uninterrupted, or that they'll be free from bugs or viruses. From time to time, access may be interrupted, suspended or restricted, including because of a fault, error or unforeseen circumstances or because we are carrying out planned maintenance.
We may suspend or disable your access to the Platforms if we consider it reasonable to do so, e.g. you breach these terms.
We will not be liable to you for any loss or damage you may suffer as a result of the Website being unavailable at any time for any reason.
You will not attempt to:
hack, make unauthorised alterations to, gain unauthorised access to, or introduce any kind of malicious code to the Platforms by any means
reverse engineer or decompile (whether in whole or in part) any software available through the Platforms unless you're allowed to do this by law
make copies, modify, reproduce, transmit, alter or distribute all or any part of the Platforms or any material or information contained in it except in your normal use of the Platforms in accordance with these terms
use the Website for any purpose that is unlawful
use the Platforms in any manner that disrupts their operation
Nothing in the above will prevent you from engaging in responsible disclosure in the event you find any security vulnerabilities in our Platforms.
The Platforms may contain links or references to third party websites and apps. Any links or references are provided for your information and convenience only. We have no control over third party websites and apps and accept no legal responsibility for any content, material or information contained in them. The display of any link and reference to any third party website or app does not mean that we endorse that third party's website, apps, products or services. Third party websites and apps may also regulate your use of their website or app or treat your data differently to Zopa. You should review any relevant terms of use and privacy-related documents before using any third party websites and apps.
We may remove or amend the content of the Platforms at any time. However, some of the content may be out of date at any given time and we are under no obligation to update it. We do not guarantee that the Platform, or any content on it, will be free from errors or omissions.
You are responsible for configuring your information technology, computer programmes and platform in order to access and use the Platforms. In particular, you should take steps to protect your devices from viruses.
4. Registration
Who can register with Zopa?
You'll need to be a UK resident, at least 18 years old, with an email address.
Other terms
Keep in mind, if you decide to use one of our products or services later you will need to agree to the specific terms for these too (for example, if you take out a loan or credit card with us) ("Service Terms"). We'll walk you through this at the time. These terms of use will be deemed incorporated into those Service Terms. If there's a conflict between these terms and the Service Terms for one of the products or services you have taken out with us, those Service Terms will prevail.
5. Access to my account
How do I access my account?
We always need to be sure that we're dealing with you before we let you access your Zopa information. We'll do this by asking for your Zopa security details, which you set when you register and can change at any time. Your security details could include:
passwords
security codes
memorable data
biometric data (such as a fingerprint)
or any other information or details you've set up with us.
If the correct security details are used, we'll assume we're dealing with you and that we're authorised to take action. We may add other ways of checking your identity in the future.
You must also help to prevent unauthorised access by keeping your security details safe. To protect your security:
never store your security details on your computer or other device in a way that enables others to impersonate you
never tell anyone your security details (nor any codes that protect any access to the nominated bank account details you provided when you opened your account)
never write your security details down
What if I think someone else got into my account?
You must contact us on the numbers below as soon as you suspect or know that someone else knows your security details or that your account is being misused.
We'll be responsible for any loss or damage resulting from unauthorised access to your account or unauthorised instructions, unless we can show that you have given someone your security details or acted fraudulently.
If we reasonably believe that you were aware that someone else knew your security details or that your account was being misused, we will only be responsible for any loss or damage up to the point you became aware.
If we're concerned about potential unauthorised access or we reasonably suspect illegal or fraudulent activity, we may block your access to Zopa or refuse to act on any instruction until we've investigated the matter.
6. Data accuracy and use
You should inform us as soon as possible if any information provided by you or in your account changes or if you become aware of any errors. You can also update information in your profile.
The content on the Platforms is provided for information only and should not be taken as advice. We'll always try to keep information on the Platforms up-to-date and accurate but can't guarantee this.
7. Intellectual property rights
We are the owner or the licensee of all intellectual property rights in the URL zopa.com, the Platforms and the material published on them. The Platforms and the content on them are protected by copyright, and you should only make personal use of the Platforms and the content.
You will retain ownership of all copyright in data you upload or submit to the Platforms. You grant us a worldwide, royalty-free, irrevocable licence to use, copy, distribute or publish and send this data in any manner (subject to our Privacy Notice).
8. Changes to these terms
We'll make changes to these terms that we reasonably believe will not put you at a disadvantage, or because we need to respond in a fair way to:
to make them easier to understand
changes in general law or decisions or recommendations made by a court, any regulator or similar organisation or ombudsman we have to follow (e.g., the Financial Ombudsman Service)
changes in regulatory requirements
new industry guidance and codes of practice
or changes to the functionality of our technology or the way we operate it.
9. What else do I need to know?
We may transfer our rights and our obligations under these terms to someone else.
You can't transfer any of your rights and obligations under these terms to anyone else.
These terms and our dealings with you before you enter into this agreement are governed in accordance with the law of the part of the UK where you are resident. The courts of that part of the UK will have exclusive jurisdiction over any disputes.
If a specific term in this document is not capable of being enforced against you, this won't affect any of the other terms.
Nothing in these terms will give any person, other than you and us, any rights under your agreement.

11. How we'll contact you
We'll generally deliver account information to your Zopa account and notices by email or by post to the most recent address you've given us.
You should check your account and email regularly and tell us as soon as possible if any of your contact details change. If you don't, we aren't responsible if you don't get information or notices from us.
